How final arbitration awards?

How are final arbitration awards?

The answer may surprise you.

For years, contract arbitration awards have been subject to limited judicial review. In fact, under state and federal laws, these awards could be challenged for reasons that were acquired through corruption or fraud, or because the arbitrators exceeded their powers. In addition, under federal law, the awards may be misrepresented by the fact that they were in clear breach of the law, ie that the arbitrators knew and understood the law, but ignored.

This may be changing. Not only the increased number of legal challenges, but several current cases suggest that the challenges based on errors of fact or law may be available.

In Strobel v. Morgan Stanley, the applicant applied to the U.S. District Court for the Southern District of California to overturn an arbitration award, the values gave him five thousand dollars in damage despite losing more than a quarter of a million as a result of their riders embezzlement. The court reviewed the sufficiency test and stated that the arbitrators manifestly disregarded the law because it did not recognize the well-established facts concerning the plaintiff damages. Due to the amount of damages awarded was not rational in relation to the amount of damages the plaintiff suffered, the court referred the matter to referees with instructions to increase the damage.

In a cable connection, Inc. v. DIRECTV, Inc., currently before the California Supreme Court, The key question is whether the parties to a commercial contract agree that an arbitration award may be reviewed for errors of fact or law. In this case, the parties agreed that the arbitrators not "have the power to commit errors of law or legal reasoning." The court vacated the award on the grounds that the arbitrators exceeded their powers by rewriting the agreement of the parties. The appellate court reversed, holding that the arbitrators exceeded their powers but rather the trial court exceeded its powers by reviewing the award for errors of law and stated that the award should be confirmed because the arbitration clause aim to expand judicial review was unenforceable.

While the California Supreme Court recently heard oral argument in connecting cables, has not yet given its opinion. To the extent the Court annulled the Court of Appeal, will be strengthened apparent movement toward increasing judicial control of arbitration awards contract to include revision of errors of fact or law. And if such an increase is indeed the trend, then contractual arbitration become less probable final (and possibly less desirable?) As an alternative to traditional litigation.
