Who Stole My Hangi?
So what's the problem with sticking some photos of a shirt, a pair of skis or a pack of cigarettes? Why have we heard about Maori up in arms because of the use of certain designs? What is the problem? "These are questions that often get from friends and colleagues, so I thought I was going to answer as best I can once and for all.
The concerns of Maori in the use of these designs depends on the "adequacy" design application. One of the major factors is that Maori depended on images and icons to pass on knowledge instead of western style written language. Therefore designs and images represent words, meanings and stories. Given this it is not surprising when the ignorant select inadequate design to grace the front of your product or its packaging, which may cause offense.
Still, what really makes a claim Maori design specific or an icon? under the law of the West, if the author of a drawing or painting dies after a certain period designs passed to the open domain and available to anyone. But wisdom does not indigenous law, which is thousands of years old differs in some respects, since the design is recognized as belonging the tribe who trust their history and meaning to the artist who created it.
Since the tribe is classified as a living entity, even after several hundred years then one could say that still belongs to the tribe by today's standards. But this is open for debate and interpretation and can mean a new chapter should be included indigenous rights to intellectual property. There are a number of large companies or corporations who have been embarrassed by the decision Maori heritage using their products or packaging, and not doing it effectively.
These include the drama of the last NZ Post with caricatures of Kapi Haka. NZ Post had the best of intentions, but the use of cartoons to represent something that is very important to Maori culture caused such outrage that the seals were removed and approximately 1 million were destroyed.
The great Danish Lego Toy company used Maori names for their characters in the series Bionicles. Initially, part of right to use names, but finally capitulated. More controversial was the snuff Morris (a large company in every sense), which marks a packet of cigarettes as "Maori Mix", containing a map of New Zealand and many Maori designs.
As expected this caused a stir among the community Maori, who have been fighting against the grip of snuff industry seems to be on the Maori people, to say nothing of the Maori heritage. The scandal led to an apology general manager and a quick withdrawal of the product. These failures beg the public. Why bother? Why sell cigarettes to Israelis Maori designs on them? In fact the design and iconography Maori is undergoing a renaissance in New Zealand, and in many ways this renaissance has been driven by a world hungry for designs that are different and have meaning. The icons of much of the Western world are largely 'plastic' and meaningless: The arches of McDonald's for example, and other icons manufactured.
The resurgence in spirituality, and an interest in alternative cultures throughout the Western world has resulted in a demand for Maori icons and designs in the form of tattoos, product decoration, and symbolism. international corporations are aware of these trends and seek to take advantage of them.
However, these classes have come home. When it comes to using images of Indians as a brand for profit, a new process is emerging. Companies are increasingly aware of the need to explore the cultural sensitivity, and property offense of a trademark if it consists of indigenous images or references, before making use of it. These consultations may be with the elders, clans, iwi, institutions language, government departments, and other artists, for example. This all goes to promote the authenticity and depth to a product or service – and most importantly, promotion of our culture properly.
While larger corporations are investing in this process smaller companies really do not know what to do. Problems arise from the people who are not fully informed or have been poorly advised about the market and how to go about the use of Maori designs correctly. There is a cultural renaissance, Maori renaissance, are being developed in New Zealand. This shows that Maori are alive and well and are doing everything possible to protect what remains after a hundred and fifty years of colonialism.
While larger companies are investing in this process smaller companies actually not knowing what to do. The problems stem from people who were not fully informed or have been poorly advised about the market and how to go about the use of Maori designs correctly. There is a cultural renaissance, a renaissance of Maori are being developed in New Zealand. This shows that Maori are alive and kicking and are doing what they can to protect what remains after one hundred and fifty years of colonialism.
Those with the intention to use the design can be Maori benefit in the knowledge that Maori are united on all fronts in the protection and preservation of their cultural identities with fierce passion. There are always people ready to take advantage of the uniqueness of Maori culture which bring the overall mix. Unless you have the credibility and respect in the community, expect to see a war party to your door with a blow by the cultural watchdogs or protectors of Maori culture.
